A CHARTER ORDINANCE EXEMPTING THE CITY OF ST. JOHN, KANSAS, FROM K.S.A. 15-809 AND PROVIDING SUBSTITUTE PROVISIONS ON THE SAME SUBJECT; SALE OF ELECTRICAL DISTRIBUTION SYSTEM AND INVENTORY ITEMS ASSOCIATED THEREWITH; APPLICATION OF THE PROCEEDS THEREFROM.
Section 1. The City of St. John, Kansas, a city of the third class, by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to and exempts Itself from and makes inapplicable to said city, KSA 15-809 which applies only to cities of the third class and applies to said city, and further reflects to provide substitute provisions as hereinafter provided.
Section 2. The City of St. John, Kansas, which owns and operates an electrical distribution system outside a three mile radius of the city is hereby authorized to sell the same and such inventory items as are associated therewith.
Section 3. Title to the above described electrical distribution system and inventory Items shall be conveyed by a bill of sale signed by the mayor and attested by the city clerk.
Section 4. The proceeds from said sale shall be and constitute an electrical utility capital improvements fund which may be invested or expended for the capital improvement of the remaining electrical utility operated by said city, or to apply to outstanding bonds or obligations of said electrical utility system as the governing body may deem appropriate.
