CHAPTER 11. PUBLIC OFFENSESCHAPTER 11. PUBLIC OFFENSES\Article 6. Curfew

It shall be unlawful for any child under the age of 18 years to wander, lounge, loaf, loiter or play in, drive a vehicle, or be a passenger in a vehicle, in about or upon any public street, alley, sidewalk, vacant lot, public place or other place normally accessible by the general public, whether on foot or in a vehicle or by any other means between the hours of midnight and before 5:00 a.m.

It shall be unlawful for any parent, legal guardian, or other person exercising legal custody of a child under the age of eighteen to suffer, permit or allow any such child to wan wander, lounge, loaf, loiter or play in, drive a vehicle, or be a passenger in a vehicle, in about or upon any public street, alley, sidewalk, vacant lot, public place or other place normally accessible by the general public, whether on foot or in a vehicle or by any other means between the hours of midnight and before 5:00 a.m.

Sections 11-601 and 11-602 shall not apply if such minor under the age of 18 is:

(a)   Accompanied by a parent, legal guardian, or other adult person exercising legal custody of the child;

(b)   Engaged in employment related activity or going to or returning home from an employment related activity, without detour or stop; or

(c)   Attending any official school, religious, or other recreational activity supervised by adults and sponsored by the City, a civic organization, educational institution, or other similar entities that take responsibility for the minor, or going to or returning home from, without any detour or stop, such exempt activity.

Any person violating any of the provisions of this article shall upon conviction thereof, be punished by a fine of not less than $50.00 and not more than $150.00.  As an alternative to a fine, the violating minor may be ordered to perform up to 50 hours of community service, with such community serve approved by the Court and City Attorney.
